By reserving a yacht or using our Service, you consent to these Terms. If you do not agree with any part of the terms, you are not permitted to use the Service.

2. Service Overview

OpenCommunityHaven offers upscale yacht charter services, including:

  • Yacht rentals for the day
  • Evening boat cruises
  • Company retreats
  • Exclusive gatherings
  • Extended yacht charters

All services are offered based on availability and subject to weather conditions. Our company maintains the right to alter or cancel services without prior notice.

3. Booking and Reservations

3.1 Booking Process

For booking a charter, you are required to:

  • Be a minimum of 18 years old
  • Supply truthful and complete details
  • Remit the necessary prepayment as indicated in your booking confirmation
  • Accept these Terms & Conditions

3.2 Confirmation

A booking is deemed confirmed only after payment has been made and our written approval has been dispensed. We retain the authority to decline service to anyone for any reason.

3.3 Availability

Charter services depend on the accessibility of the vessel and favorable weather conditions. We pledge to endeavor to accommodate your chosen dates and times.

4. Payment Terms

4.1 Pricing

Our prices are quoted in € and incorporate applicable taxes unless stated otherwise. Prices may change without notification.

4.2 Payment Schedule

  • Deposit: 50% of the whole charter cost is required at the time of booking
  • Remaining Amount: To be paid 48 hours before the charter commences
  • Extra fees (if applicable): To be settled post-charter completion

4.3 Payment Methods

We accept prominent credit cards, bank wire transfers, and certified bank drafts. Payment processing is conducted using secure, encrypted technologies.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • More than 72 hours prior to departure: Total refund minus any processing charges
  • 24-72 hours before departure: Refund of 50% of the payment
  • Less than 24 hours before departure: No refund is provided

5.2 Weather Cancellations

Should the weather be deemed unsafe for sailing by our captain, we propose to:

  • Reschedule to a new date without additional charges
  • Issue a full refund in case of inability to accommodate a rescheduled time

5.3 Mechanical Issues

If mechanical problems occur with the vessel assigned to you, we will aim to supply a substitute of equal calibre. If an alternative is unavailable, a full refund will be issued.

6. Safety and Conduct

6.1 Safety Requirements

Passengers are obligated to:

  • Heed all commands from the crew
  • Make use of the safety equipment when deemed necessary
  • Disclose any medical conditions that might impact their safety
  • Stay within specified sections of the boat

6.2 Prohibited Items

The following items are not allowed on the yacht:

  • Containers made of glass
  • Illegal materials
  • Weapons or firearms
  • Excessive amounts of beverages (exceeding a reasonable quantity for consumption)
  • Animals (except with prior authorization)

6.3 Conduct

Patrons must maintain respectful behavior at all times. A charter may be terminated prematurely without reimbursement if a passenger's conduct endangers safety or interferes with the enjoyment of others.

7. Liability and Insurance

7.1 Our Liability

We limit our liability to the sum paid for your charter. We do not hold responsibility for:

  • Personal injuries due to negligence of the passengers
  • Loss or damage of personal belongings
  • Indirect, resultant, or penal damages
  • Delays caused by weather or situations beyond our control

7.2 Insurance Coverage

We possess comprehensive marine insurance that covers our fleet and operational activities. Passengers need to ensure their own travel and personal insurance arrangements.

7.3 Assumption of Risk

Engaging in our charter services indicates your acknowledgement of the inherent risks involved in maritime activities and your acceptance of personal responsibility for your safety and welfare.

8. Modifications and Itinerary Changes

We maintain the right to adjust itineraries, routes, or timetables due to weather circumstances, security needs, or operational imperatives. We shall strive to deliver equivalent alternative experiences wherever feasible.

9. Force Majeure

We do not bear liability for holdups, cancellations, or changes brought about by forces outside our control, which include, but are not limited to:

  • Extreme weather disturbances
  • Natural calamities
  • Regulatory directives
  • Harbour shutdowns
  • Vessel malfunctions

10. Privacy and Data Protection

Your personal details are managed pursuant to our Privacy Policy. By employing our services, you consent to our collection and utilization of information in line with the stipulations of our Privacy Policy.

11. Intellectual Property

The content on our website, such as text, visual designs, logos, and images, is safeguarded by copyright and trademark statutes. Reproducing, disseminating, or creating derivative works without our explicit consent is prohibited.

12. Governing Law

These Terms are subject to the laws in force in Malta. Disputes will be settled in courts situated in Valletta, Malta.
